Getting a Restraining Order
We can work with survivors of domestic violence on getting a restraining order placed on their spouse. These orders come in three different ways:
- Emergency Protective Order (EPO): This is an order that can be issued outside of normal business hours. An EPO only lasts for 72 hours. They have to be requested by the police, based on a belief that the victim is in imminent danger.
- Temporary Protection Order (TPO): The TPO will last for roughly 14 days. Its purpose is to provide protection while waiting for a court date that will determine if a longer order is justified. Our office will work to help you secure a TPO.
- Permanent Protection Order (PPO): These orders are, as their name indicates, permanent, although they can be periodically reviewed after two years. During a review, a full court hearing will be held, and the defendant will be able to argue against the order. The victim is obligated to attend in person for a PPO to be granted.

Restraining Order Restrictions
The restrictions applied in a restraining order can include a ban on the restrained person from texting or calling. They often include a radius of space near the protected party (i.e., 100 yards) that the restrained person may not breach. There can also be a provision that the restrained party continue to pay the household bills while the restraining order is in place.
A restriction on parenting time is also possible. While courts are often averse to completely preventing a parent from seeing their children, this is a possible means to protect your children when they are not safe in the other parent’s care.. More likely, an abusive parent may have their parenting time restricted so that it only takes place in the presence of someone supervising them..
